A five-member panel of the Supreme Court has reiterated Samuel Anyanwu as National Secretary of the Peoples Democratic Party, PDP.
The panel in a unanimous judgement held that the matter on the leadership of party is an internal one rather than the business of a court.
In the lead judgement read by Justice Jamilu Tukur, the Supreme Court invalidated the decision of the Appeal Court, Enugu Division which affirmed the removal of Anyanwu by a Federal High Court in Enugu. The judgement said the Federal High Court lacks jurisdiction to have heard the matter instituted by Aniagwu Emmanuel.
The apex court said that Udeh Okoye was not joined in the case implied that Aniagwu Emmanuel did not have the right to institute the matter in court.
It said the Federal High Court in Enugu would have the jurisdiction to entertain the matter if it had involved the commission of a crime or violation of contractual rights.
